1/ Service provided by Writerfind.com may be cancelled at any time provided one month’s notice is given in writing.  Writerfind.com is owned and operated by Nicole Bishop.

2/ Accounts are in default if payment is not received within 14 days after the due date on an invoice or renewal notice. All files, information and mail under the account will be preserved for 14 days from the date the payment is due. If the payment is not received after 14 days, all files and information under the account will be deleted. If the subscriber wishes to use the service again, the subscriber must re-apply as a new subscriber. For this, an activation fee will be required.

3/ Writerfind.com reserves the right to change its rates by notifying the subscriber 30 days in advance of the effective date of the change.

4/ The subscriber shall have exclusive responsibility for ensuring that his or her information is  legal, honest, accurate and truthful; does not  infringe the copyright, design, privacy, publicity, data  protection, trade mark or any other rights of any third party  and is not obscene, libellous or defamatory of any person;  does not breach any applicable law or regulation and complies with national and international codes of advertising and sales promotion.  

The subscriber shall not use pseudonyms or pen-names.

All questions and complaints from individuals viewing the subscriber information are the exclusive responsibility of the subscriber and shall be handled by the subscriber

5/ The subscriber indemnifies and holds harmless Writerfind.com from and against all costs, claims, damages, losses, liabilities and expenses (including legal expenses on a solicitor and client basis) arising directly or indirectly from submitted material or other material contained on the web-site in the name of the subscriber.

The costs, claims, damages, liabilities and expenses referred to include, but are not limited to, the following

• negligent or fraudulent misrepresentations;
• breach of copyright, trade mark or other intellectual property right; or
• defamation

Writerfind.com will in no event be liable to the subscriber, or any person claiming through or under the subscriber, for any direct, special, consequential or incidental damages of any kind in respect of: 

• any unauthorised use of, or access to, any credit card number supplied by the subscriber to Writerfind.com;

• submitted material or other material contained on the web-site in the name of the subscriber;

• the characteristics, qualities, conduct or background of any client or employer, or prospective client or employer, who contacts, employs, contracts with or engages the subscriber; or

• computer viruses or other hardware or software deficiencies in relation to the web-site or the services supplied by Writerfind.com

 Writerfind.com shall provide the web site "as is". The subscriber agrees that it is technically impossible for Writerfind.com to provide the Web Site uninterrupted, free of faults or to guarantee that the web site will not be infiltrated by unauthorised users or hackers.

The subscriber agrees that the maximum aggregate liability of Writerfind.com for any loss or damage whatever arising from or in  any way connected with this agreement shall, in respect of any one or more events or series of events (whether connected or unconnected) taking place within any twelve month period be limited to the total fees in any year of this agreement.

Nothing in this agreement shall exclude any other liability which it is prohibited from excluding by law.  

6/ Writerfind.com may remove the subscriber from the web-site, or refuse to enter the subscriber on the web-site, at its sole discretion, at any time and without needing to provide any reasons for removing or refusing the subscriber.

7/ These terms and conditions shall in all respects be governed by  New Zealand law and the subscriber submits to the exclusive jurisdiction of the New Zealand courts.

8/ Refund Policy: Refund will be given at the discretion of Writerfind.com’s management.  

9/ Order acceptance and the completion of the contract between you and us will take place on the provision of services ordered by you unless we have notified you that we do not accept your order.

Non-acceptance of an order may be a result of one of the following:

* The service you ordered cannot be supplied
* Our inability to obtain authorisation for your payment
* The identification of a pricing or service description error
* You do not meet the eligibility to order criteria set out in the Terms and Conditions

10/ These terms and conditions supersede all previous representations, understandings or contracts and shall prevail notwithstanding any variance with terms and conditions of any order submitted. Use of Writerfind.com's services constitutes acceptance of these terms and conditions.
